SHORT TERM RENTAL TERMS & CONDITIONS
By booking accommodation you confirm acceptance that the below terms & conditions as being part of the agreement between yourself as the holiday guest and property owners of Fingal Pines Getaway, ground floor, 20 Marine Drive Fingal Bay NSW 2315. Any breach of these terms & conditions may result in your booking being cancelled or access to the property refused.
BOOKING REQUIREMENTS
- You must be at least 18 years of age to book. No schoolies.
- Full payment is required at the time of booking to secure your dates
- All reservation requests are subject to approval and confirmation by the owners of Fingal Pines Getaway
- All amounts are quoted are in Australian Dollars
- Rates are subject to change without notice
- Surcharges apply for credit card payments, Visa and Mastercard preferred. Alternatively, guests can pay via bank transfer without surcharge.
- Booking is allowable for six guests maximum to stay at the property. Pets are not permitted.
- All reservations are required to complete our guest registration. You will be required to upload Photo ID (of the booking person), credit card, and details of all guests. All information provided is securely held on the online booking platform or booking channel.
- Upon check in all guests certify that no guest is currently COVID positive. If it becomes apparent that a guest is or was COVID positive during their stay additional cleaning measures may be required and the guest agrees that they will pay for the additional cleaning.
- Smoking in any form is strictly prohibited.
- Fingal Pines Getaway takes no responsibility for guest vehicles or possessions. Guests are responsible for all insurance of their belongings and if left behind, found and requested to be returned the guest will pay for the postage.
- To cover for anything unexpected we suggest all guests, local and international, consider obtaining travel insurance.
CODE OF CONDUCT
The Code of Conduct for the Short-Term Rental Accommodation Industry applies for all bookings. The owner, guest and all persons occupying the property are bound by all terms of the Code of Conduct at all times. The guest acknowledges that any abuse or threatening behaviour towards the owners, their visitors or contractors will result in the immediate termination of the stay.
The guest acknowledges that they will follow and agrees to comply with any rules posted on site. House Rules and Evacuation plans are displayed in the premises.
By booking and fully paying all fees you acquire a licence to use the property for the purpose of a short-stay or holiday for the period listed on your booking confirmation. Under no circumstances are any commercial activities or parties to be undertaken on the property. Any booking for more than 21 nights will require a mid-stay clean at additional guest cost.
By booking a property the guest declares that they have made all enquiries and satisfied themselves as to the suitability of the property booked for their needs.
Guests agree to limit noise and not engage in activities that cause a nuisance to neighbours, or upstairs residents at any time, but particularly between 10pm and 8am.
There is zero tolerance to drunken, bullying, or loutish behaviour, the use of foul and indecent language, any form of intimidation, malicious damage, theft, or any other form of inappropriate behaviour. NSW Police will be notified and guests be evicted immediately without refund or credit of your security bond and booking. Extra charges over and above the amount of the security bond will be charged to the credit card on file.
SECURITY BOND
Each reservation will require a credit card pre-authorisation for a refundable security bond in the amount of $500.00 and your credit card details will be held on the system as security bond. In the event of damage to the property, equipment or breakages, or if extra cleaning is required, your credit card may be debited.
We will only process monies on your credit card if there is reported damage to the property. You become responsible for any-and-all damage and loss to the property and its contents from the date and time you check-in to the date and time you check-out. Please report any accidental breakages during your stay. The security bond provides no coverage against malicious damage, damage from unsupervised children or lost keys, in these instances additional costs will be incurred.
CHECK-IN, STAY & CHECK-OUT REQUIREMENTS
Unless specifically agreed and confirmed in writing, check in is no earlier than 2pm on the day of arrival and departure no later than 10am on the day of departure.
Early check-ins, or Late check-outs are strictly at the discretion of Fingal Pines Getaway and must be requested at the time of booking and can only be confirmed one day prior to arrival or departure. Whilst every effort will be made to accommodate early arrivals and late departures, the only way to absolutely ensure an early check-in or late check-out is to book an extra night. Occasionally, in the off-season we may offer late check-out bookings so that guests can enjoy more time during their stay. Check our website and social pages for promotions.
Any defects, non-working items, cleaning or other issues must be notified to Fingal Pines Getaway upon first arriving at the property. The owner will make all reasonable attempts to rectify any issues as soon as practicable, but no partial refunds will be made.
Guests agree to keep the property secure throughout their stay and if the property is unoccupied agree to keep doors and windows locked.
The whole property is non-smoking. If the cleaner or owner believes that someone has been smoking inside the property additional charges may be payable for deodorising and cleaning.
Guests agree to allow the owner or appointed tradespeople to access the property as needed to affect repairs or investigate complaints.
Upon departure the guest will ensure that the property is left secured, clean, free of rubbish, all cutlery & crockery washed, dried and re-stowed and the keys returned to the lock box. Any rubbish that cannot fit into the rubbish or recycling bins must be collected in rubbish bags by the guest. Any costs for extra cleaning, washing up or rubbish removal will be charged to the guest.
ONLINE BOOKING SYSTEM
By using our online booking system ‘Little Hotelier’ (trading as Siteminder’) ABN 59 121 931 744, you agree to their terms and conditions accessible at www.littlehotelier.com. To making a Booking, you will be required to set up a user account. The person making the Booking will be the registered guest. However, all guests staying at the Property are subject to these terms and conditions.
You consent to providing your personal data and acknowledge that if you do not consent, we may not be able to provide some or all of the services including the short-term rental of the Property pursuant to the Booking (Services). For more information regarding personal data, please refer to our Privacy Policy. You agree that all information you provide to us will be true, accurate, current and complete. You agree that you are responsible for all information that you submit to us, and you acknowledge that if we believe that the information provide to us by you is false, inaccurate or misleading, we may, at our sole discretion, suspend or terminate your access to the Website and our Services.
PRIVACY
Fingal Pines Getaway agree to comply with the Privacy Act 1988 (Cth) and all other applicable privacy laws and such other data protection laws as may be in force from time to time which regulate the collection, storage, use, and disclosure of information about identifiable individuals (Personal Information) held by or on behalf of the Guest to the extent that they are legally obligated to comply with these laws. Please also refer to the privacy policy of our online booking system available online at www.littlehotelier.com.
By booking online, the guest confirms their permission for us to store and use the collected data to get back in touch with them about their booking, and to offer them future opportunities to book. CANCELLATIONS
Written notification must be provided for all cancellations, email holiday@fingalpines-getaway.au
For bookings made 48 hours or less before the scheduled arrival date there is no refund available for a cancellation.
If the owner has cancelled a booking or enforced an early departure due to any breach of terms and conditions or code of conduct no refund will be made.
Cancellations with MORE THAN 30 days of notice prior to your arrival, are fully refundable.
Cancellations WITHIN 30 days of your arrival date, incur a 50% cancellation fee of the total booking charge, unless the guest books the property at the same tariff on another date within the next 6 months.
If a cancellation is made because Port Stephens or the locality of the guest has been placed into any pandemic lockdown a full refund will be given.
All refunds are made via the same credit card as used during booking, or bank transfer (as applicable). The guest is to ensure that correct banking details are provided.
